Welcome to Ozaro.fit ("Platform"). These Terms of Usage ("Terms") govern your access to and use of the Ozaro.fit website, mobile applications, and services (collectively, the "Services"), operated by OZAROFIT PRIVATE LIMITED, a company incorporated in India, having its registered office in Gurugram, Haryana ("Ozaro.fit", "we", "us", or "our").

1. Eligibility & User Responsibility

• The Services are available to users of all ages.
• Minors may use the Services only with the consent, supervision, and presence of a parent or legal guardian.
• By using the Services, you confirm that all information provided by you is accurate, current, and complete.

2. Nature of Services

Ozaro.fit provides:

• Fitness assessments
• Guided workouts
• In-person fitness sessions conducted by trainers at a user's home, clubhouse, or other mutually agreed locations
• Wellness programs including yoga, dance fitness, and general workouts

3. Health & Medical Disclaimer

• Participation in physical activity involves inherent risks.
• You are solely responsible for assessing your physical fitness and readiness to participate.
• You must disclose any injuries, medical conditions, or physical limitations to the trainer prior to sessions.
• Users are advised to consult a qualified medical professional if they have any pre-existing condition or special medical history.
• Ozaro.fit shall not be responsible for injuries or health issues resulting from non-disclosure, improper execution of exercises, or disregard of medical advice.

4. User Accounts & Access

• Account creation is mandatory to access Services.
• Authentication is done via mobile number and OTP.
• You are responsible for maintaining the confidentiality of your account and activity conducted through it.
• Requests for account deletion must be emailed to support@ozaro.fit. Certain records may be retained for taxation, legal, and compliance purposes.

5. Free Assessment / Trial

• Ozaro.fit may offer one complimentary assessment or trial session at its discretion.
• Trial availability and eligibility are subject to change or withdrawal without notice.

6. Subscriptions, Payments & Pricing

• Paid services are offered through subscription packages for a fixed number of sessions.
• Payments are processed via third-party gateways such as Razorpay or other authorized providers.
• Prices may change only at the time of renewal or purchase of a new subscription.

7. Refund & Cancellation Policy

• No refunds are provided once a subscription has commenced.
• Refunds may be considered only if Ozaro.fit is unable to deliver the agreed service.
• All refund decisions are final and at Ozaro.fit's sole discretion.

8. Trainer Assignment & Scheduling

• Trainers are assigned based on availability, location, and program requirements.
• Ozaro.fit does not guarantee continuity of the same trainer.
• Rescheduling and cancellations must comply with policies communicated at booking.

9. Ratings & Feedback

• Users may rate trainers only after successful completion of a scheduled session.
• Feedback must be truthful, respectful, and non-abusive.
• Ozaro.fit reserves the right to remove misleading or inappropriate feedback.

10. Intellectual Property

• All content on the Platform, including videos, workout plans, text, branding, and graphics, is the exclusive property of Ozaro.fit.
• Users are strictly prohibited from copying, recording, downloading, sharing, reproducing, or commercially exploiting any content without prior written consent.

11. Circumvention of Platform & Direct Engagement

All bookings, payments, communications, and services with trainers or Ozaro.fit staff must be conducted exclusively through the Ozaro.fit Platform.

Any attempt to:

• Engage trainers or staff directly outside the Platform
• Make off-platform payments
• Privately schedule or continue sessions
• Bypass Ozaro.fit after subscription expiry

shall be considered circumvention of the Platform.

12. POSH Policy, Safety & Reporting

Ozaro.fit is committed to maintaining a safe, respectful, and harassment-free environment for all users and trainers, in accordance with applicable Indian laws, including principles under the POSH (Prevention of Sexual Harassment) framework.

• Any form of harassment, inappropriate behavior, misconduct, or safety concern must be reported immediately to support@ozaro.fit.
• Ozaro.fit treats safety concerns with utmost priority and seriousness.
• Reported incidents will be reviewed promptly, and appropriate action may be taken, including suspension or termination of access.
• Failure to report incidents in a timely manner may impact Ozaro.fit's ability to investigate or act effectively.

13. Prohibited Conduct

Users agree not to:

• Misuse or share accounts
• Engage in abusive, threatening, illegal, or inappropriate conduct
• Attempt to reverse-engineer, scrape, or tamper with the Platform
• Interfere with trainers, staff, or service operations
• Use the Platform for unauthorized commercial purposes

14. Account Suspension & Termination

Ozaro.fit reserves the right to:

• Suspend or permanently terminate accounts
• Deny access to Services
• Remove users from the Platform at any time, with or without notice, for violation of these Terms or misuse of Services

15. Limitation of Liability

To the maximum extent permitted by law:

• Participation in fitness activities is entirely at the user's own risk.
• Ozaro.fit shall not be liable for injuries, health issues, losses, or damages arising from participation in workouts or services.
• Ozaro.fit is not responsible for trainer actions outside scheduled sessions or agreed scope.

16. Third-Party Services

Ozaro.fit may integrate third-party services such as payment gateways. Ozaro.fit is not responsible for their availability, performance, or policies.

17. Platform Disclaimer

• The Services may be accessed through third-party platforms or marketplaces. Such third parties are not responsible for the Platform, its content, services, or any disputes arising from the use of the Services.
• All claims, questions, or disputes related to the Services must be directed solely to Ozaro.fit.

18. Changes to These Terms

Ozaro.fit may update these Terms from time to time. Continued use of the Services after changes constitutes acceptance of the updated Terms.

19. Governing Law & Dispute Resolution

• These Terms are governed by the laws of India.
• Any dispute shall be resolved through arbitration in Gurugram, Haryana, under the Arbitration and Conciliation Act, 1996.
• Courts at Gurugram, Haryana shall have exclusive jurisdiction for enforcement.
